You use our platforms and services, and enter our premises at your own risk. 

Kindly note that Benguela Cove is a working farm. All persons enter and use the premises at their own risk. The owners, management and their employees, agents and contractors will not be liable for injury or damage of any nature whatsoever suffered by any person who enters the premises or use the amenities provided, whether arising from negligence or any other cause whatsoever. 

While we endeavour to ensure that the information on our platforms is correct, we do not warrant the accuracy and completeness of content on our platforms or that the content and technology available from our platforms, products or services are free from defects, errors or omissions. 

We may make changes to the content on our platforms or services at any time without notice. The content on our platforms or services may be out of date, and in this regard, we make no commitment to update such content. 

To the extent allowed by law, we shall not be liable for any damage, loss or liability of whatsoever nature arising from your use or inability to use our Platforms, Services or Content. 

Our platforms, services and content are supplied on an "as is" basis and have not been compiled or supplied to meet any user's individual requirements. It is your sole responsibility to satisfy yourself prior to entering into this agreement with us that the services available on or through our Platforms will meet your individual requirements. 

Information, ideas and opinions expressed on our platforms should not be regarded as professional advice or our official opinion and you are encouraged to consult professional advice before taking any course of action related to information, ideas or opinions expressed on our platforms. 

  • Terms and Conditions for Individual and Group Bookings 

    1. At the time of booking, a 50% deposit is required to secure your place. 

    1. The balance of 50% is due at least 7 (seven) days before the activity is due to take place. If your booking is made less than 7 (seven) days before the activity is due to take place, the full amount must be paid for the activity to secure the booking. 

    1. Cancellation policy: 

      1. Cancellations made at least 1 (one) month in advance – the full amount paid is refunded, less a 10% admin fee; 

      2. Cancellations made between 7 (seven) days and 1 month in advance – the deposit is forfeited; 

      3. Cancellations made within the 7 (seven) days leading up to the activity – the full fee is due and payable; 

    1. Any change to the number of people booked must be communicated more than 7 (seven) days in advance of the planned activity, otherwise you will be charged for the amount of people in the original booking. Should you wish to add additional people to a booking, the amount will be added to the original booking fee. 

    1. Every participant undertakes the activity at own risk. Parents or guardians accept full responsibility for those under 18. 

    1. Bad weather conditions; we commit to delivering the activity or service as booked, unless it becomes a safety concern due to weather. We will rebook the date or issue you with a voucher to be used with our company again valid for 1 (one) year depending on availability – we do not refund. 

    1. We must be informed of any medical problem, disability, dietary requirement or any other problem that could affect the activity. 

    1. Timing is everything as we take multiple bookings per day unless you have booked the day exclusively – if you arrive late, please understand your actions put us and your group activities under pressure and we will try and give you the full experience if possible. We however reserve the rights to shorten your excursion if need be due to late arrival. 

    1. Alcohol or the use of illegal substance are not allowed on or prior to our activities and we reserve the right to cancel a booking without a refund. We do allow the consumption of alcohol on site but in moderation and after the activities booked. 

    1. In the event of unforeseeable circumstances, policies can be amended at the discretion of Benguela Cove Investments (PTY) Ltd. 

    1. Benguela Cove Investments (PTY) Ltd shall under no circumstances be liable for any act or omission of any outsourced operators. 

  • Guests understand that Benguela Cove Investments (PTY) Ltd. has arranged one or more transports for purposes of tourism activities on BENGUELA COVE LAGOON WINE ESTATE. 

    Guests confirm that the use of the service is entirely voluntary, and guests accept all risks involved therein. Accordingly, Benguela Cove Investments (PTY) Ltd., its drivers, agents and employees shall NOT be liable for any loss, damage, injury or illness of whatsoever nature and howsoever caused, suffered by guests, or the minor child, or disabled passengers for whom they are the parent or legal guardian, as a result, directly or indirectly, of using the service due to any reason whatsoever, and Benguela Cove Investments (PTY) Ltd., its drivers, agents, employees, shall NOT be liable for any loss and/or damage (including indirect or consequential loss and/ or damage) arising from the service.

  • The alcohol-based goods we offer are exclusively for adults. We shall therefore only sell and deliver alcohol-based goods to legally competent persons over the age of 18 and may request appropriate proof of age. The necessary order details - such as name, address, date of birth - must be complete and truthful. Minors (younger than 18 (eighteen) years), must be accompanied by an adult guardian.

  • These Rules Are Applicable to Any and All Vouchers issued by Benguela Cove Investments (PTY) Ltd.: 

    1. Prior bookings with the voucher system must be made before arrival.  

    1. Vouchers may only be redeemed if the company is aware of the voucher and a booking email is sent to us with your request and any outstanding amount is paid. 

    1. If you book and arrive late or no-show the voucher will be valued as redeemed and you will not be allowed to use this voucher again. 

    1. We reserve the rights to move your booking if you did not us inform us of your reservation and voucher prior to arrival. 

    1. Water based activities have minimum numbers needed before we book the activity – please check availability and inform us of your vouchers. 

    1. The above terms and conditions apply to all vouchers. 

    1. Vouchers applicable on full price only - no specials. 

    1. No adjustment to dates, times or any alterations of your bookings with less that 7 (seven) days from the actual booking – a full cancellation fee is then applicable.
